Q. WHAT IS TEACHER ELIGIBILITY TEST ( TET EXAM) EXAM? WHY IT IS IMPORTANT TO BECOME TEACHER?

ANS : TEACHER ELIGIBILITY TEST ( TET EXAM) EXAM PASS QUALIFICATION IS MANDATORY TO BECOME TEACHER AS PER NCTE GUIDELINES / RTE ACT.

CENTRAL  GOVERNMENT PASSED RTE ACT ON 23RD AUGUST 2010 IN ITS GAZETTE NOTIFICATION ( BHARAT KA RAJPATRA).

NCTE HAS POWER TO FRAME RULES FOR TET EXAM TO MAINTAIN QUALITY IN EDUCATION SYSTEM-
In accordance with the provisions of sub - section (1) of section 23 of the Right of Children to Free and Compulsory Education (RTE) Act, 2009, the National Council for Teacher Education (NCTE) has laid down the minimum qualifications for a person to be eligible for appointment as a teacher in class I to VIII , vide its Notification dated August 23, 2010

 Q. What should be qualification to become teacher under RTE Act for class 1 to 8.
Ans: Minimum qualification is as per academic authority ( currently NCTE) authorized by central government of India by notification.
NCTE prescribed compulsory TET pass qualification to become teacher under RTE.

Central Government can give relaxation in qualification to state government under following conditions :-
Where a State does not have adequate institutions offering course or training in teacher education, or teachers possessing minimum qualifications as laid down under sub-section (1) are not available in sufficient numbers, the Central Government may, if it deems necessary, by notification, relax the minimum qualifications required for appointment as a teacher, for such period, not exceeding five years, as may be specified in that notification :
Provided that a teacher who, at the commencement of this Act, does not possess minimum qualifications as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years.

(Example: In UP, UPTET pass candidates are in sufficient large numbers approx 3 Lakh, And this causes problem for Shiksha Mitra to beocme Teacher under RTE act)



Q. Is there any specific guidelines/ rule for selected teacher under RTE Act?
Ans: Teacher under RTE Act shall perform duties for educational purpose only. However they can be engaged in collecting population census data related matters, disaster relief duties and election duties.

Q. Can teacher under RTE Act perform private tution . private teaching activity.
Ans : RTE Act clearly denies  for Private tuition/ private teaching activity.

Q.What is RTE Act?
Ans : RTE ( Right to Education) Act OR  Right of Children to Free and Compulsory Education (RTE) Act, 2009, is Eighty-sixth Amendment) Act, 2002 inserted Article 21-A in the Constitution of India to provide free and compulsory education of all children in the age group of six to fourteen years as a Fundamental Right in such a manner as the State may, by law, determine. The Right of Children to Free and Compulsory Education (RTE) Act, 2009, which represents the consequential legislation envisaged under Article 21-A, means that every child has a right to full time elementary education of satisfactory and equitable quality in a formal school which satisfies certain essential norms and standards.

 Article 21-A and the RTE Act came into effect on 1 April 2010. The title of the RTE Act incorporates the words ‘free and compulsory’. ‘Free education’ means that no child, other than a child who has been admitted by his or her parents to a school which is not supported by the appropriate Government, shall be liable to pay any kind of fee or charges or expenses which may prevent him or her from pursuing and completing elementary education. ‘Compulsory education’ casts an obligation on the appropriate Government and local authorities to provide and ensure admission, attendance and completion of elementary education by all children in the 6-14 age group. With this, India has moved forward to a rights based framework that casts a legal obligation on the Central and State Governments to implement this fundamental child right as enshrined in the Article 21A of the Constitution, in accordance with the provisions of the RTE Act.

The RTE Act provides for the:
  • Right of children to free and compulsory education till completion of elementary education in a neighbourhood school.
  • It clarifies that ‘compulsory education’ means obligation of the appropriate government to provide free elementary education and ensure compulsory admission, attendance and completion of elementary education to every child in the six to fourteen age group. ‘Free’ means that no child shall be liable to pay any kind of fee or charges or expenses which may prevent him or her from pursuing and completing elementary education.
  • It makes provisions for a non-admitted child to be admitted to an age appropriate class.
  • It specifies the duties and responsibilities of appropriate Governments, local authority and parents in providing free and compulsory education, and sharing of financial and other responsibilities between the Central and State Governments.
  • It lays down the norms and standards relating inter alia to Pupil Teacher Ratios (PTRs), buildings and infrastructure, school-working days, teacher-working hours.
  • It provides for rational deployment of teachers by ensuring that the specified pupil teacher ratio is maintained for each school, rather than just as an average for the State or District or Block, thus ensuring that there is no urban-rural imbalance in teacher postings. It also provides for prohibition of deployment of teachers for non-educational work, other than decennial census, elections to local authority, state legislatures and parliament, and disaster relief.
  • It provides for appointment of appropriately trained teachers, i.e. teachers with the requisite entry and academic qualifications.
  • It prohibits (a) physical punishment and mental harassment; (b) screening procedures for admission of children; (c) capitation fee; (d) private tuition by teachers and (e) running of schools without recognition,
  • It provides for development of curriculum in consonance with the values enshrined in the Constitution, and which would ensure the all-round development of the child, building on the child’s knowledge, potentiality and talent and making the child free of fear, trauma and anxiety through a system of child friendly and child centred learning.

Chhattisgarh Teacher Eligibility Test (CG TET) Examination will be conducted  by the Chhattisgarh Professional Examination Board on August 31, 2014 at several examination centers in the state.
The Chhattisgrah Professional Examination Board, Raipur has uploaded the CG TET Admit Card/Hall Ticket 2014 on its official website i.e. cgvyapam.choice.gov.in/
All questions in CG TET test will be multiple-choice questions (MCQs), each carrying one mark, with four alternatives out of which one answer will be correct. There will be no negative marking. There will be two papers of CG TET.
(i) Paper I will be for a person who intents to be a teacher for classes I to V.
(ii) Paper II will be for a person who intents to be a teacher for classes VI to VIII.
A person who intents to be a teacher for both levels (classes I to V and classes VI to VIII) will have to appear in both the papers (Paper I and Paper II).
Duration of examination is one-and-a-half hours for each paper.
CGTET Paper I (for classes I to V):
Structure and Content (All Compulsory) :
(i) Child Development and Pedagogy    30 MCQs      30 Marks
(ii) Language I                                            30 MCQs      30 Marks
(iii) Language II                                          30 MCQs      30 Marks
(iv) Mathematics                                        30 MCQs      30 Marks
(v) Environmental Studies                         30 MCQs      30 Marks
      Total                                                       150 MCQs     150 Marks
Exam time: 9:15 AM to 11:45 AM (Paper I) and 02:15 P.M to 04:45 P.M.(Paper II)
Candidates having completed Senior Secondary or its equivalent with at least 50 per cent marks or 2-year Diploma in Elementary Education are eligible for taking the test for teacher for classes I to V.
Candidates having a graduation degree and two-year Diploma in Elementary Education or Bachelor in Education (B.Ed) degree can apply for teacher for classes VI to VIII.

Teachers who are appointed have to possess requisite qualification prescribed by the National Council for Teacher Education (NCTE) and pass the Teacher Eligibility Test (TET)





Over 600,000 primary teachers' posts lying vacant

Over 600,000 posts of teachers at primary level are lying vacant under the state sector and the national literacy mission, parliament was informed on Monday.

"The total teachers post lying vacant at the primary level both under the state sector and the Sarva Shiksha Abhiyan are 6, 06, 191," human resource development Minister Smriti Irani told the Rajya Sabha in a written reply.

"The states recruits teachers based on their recruitment rules. However, teachers who are appointed have to possess requisite qualification prescribed by the National Council for Teacher Education (NCTE) and pass the Teacher Eligibility Test (TET)," she added.
Irani said that the recruitment of teachers on contract basis therefore does not affect the quality of teaching adversely as all teachers recruited have to meet the educational qualification as well as professional qualifications.

"However, professional qualifications are sometimes relaxed under section 23 of the right of children to free and compulsory education (RTE) Act, 2009 for states where there is a shortage of professionally qualified teachers, with the provision that they acquire the same through a two year training programme in distance mode," she said.

Irani also informed that the pupil teacher ratio (PTR) has improved nationally to 1:25 and most states barring Bihar, Jharkhand and Uttar Pradesh have normative PTRs.

No relaxation from TET ( Teacher Eligblity Test) is Possible
सी टी ई टी / टी ई टी से छूट तो स्वयं कोर्ट भी नहीं दे सकती , क्यूंकि आर टी ई एक्ट संविधान का एक हिस्सा है ,
और केंद्र सरकार के गजट नोटिफिकेशन में प्रकाशित है ।
अब यह छूट संविधान में परिवर्तन के तहत ही मिल पाएगी

मेरा कहना है की आर टी ई एक्ट के तहत शिक्षक बनने के लिए टी ई टी / सी टी ई टी से छूट किसी को नहीं अगर समुचित मात्रा में योग्य टी ई टी
पास शिक्षक उपलब्ध है तो ।

अभी हाल ही में नैनीताल हाई कोर्ट ने निर्णय दिया है की टी ई टी से छूट तो एन सी टी ई और उत्तरांचल राज्य सरकार भी नहीं दे सकती ,

उत्तर प्रदेश में भी दो बार ट्रिपल बेंच बैठ चुकी है जिसमें एक ट्रिपल बेंच ( तीन जजों की बेंच) खास तोर से टी ई टी में छूट देने के सन्दर्भ में बनाई गयी थी ।
जिसमें साफ़ किया गया की टी ई टी से छूट संभव नहीं

सीटैट के बगैर भी बन सकेंगे शिक्षक 

केंद्रीय शिक्षक पात्रता परीक्षा (सीटैट) पास किए बगैर भी आप शिक्षक बन सकते है। केंद्रीय प्रशासनिक पंचाट (कैट) ने शिक्षकों की कमी दूर करने के लिए केंद्र व दिल्ली सरकार से शिक्षक नियुक्ति में सीटैट की अनिवार्यता में छूट देने का निर्देश दिया है। पंचाट ने सरकार से सीटैट की जगह अनुभव को तरजीह देने का निर्देश दिया है।

पंचाट के न्यायिक सदस्य ए.के. भारद्वाज और बिरेंद्र कुमार की पीठ ने यह आदेश सीटैट की योग्यता नहीं होने की वजह से नौकरी से निकाले गए ठेका पर कार्यरत शिक्षकों की ओर से दाखिल याचिका का निपटारा करते हुए दिया है। पीठ ने अपने फैसले में शिक्षा के अधिकार अधिनियम की धारा-23 का हवाला देते हुए कहा है कि प्रशिक्षित शिक्षकों के अभाव में केंद्र सरकार अधिसूचना जारी कर शिक्षकों की नियुक्ति में शिक्षक पात्रता परीक्षा पास करने की अनिवार्यता में छूट दे सकती है

पीठ ने सरकार से सभी याचिकाकर्ताओं को दोबारा नौकरी देने पर विचार करने का निर्देश दिया है। गौरतलब है कि केंद्रीय प्रशासनिक पंचाट में केंद्र सरकार और केंद्र शासित प्रदेशों में नियुक्ति, प्रमोशन एवं अनुशासनात्मक कार्रवाई से संबंधित विवादों का निपटारा किया जाता है

कॉन्ट्रैक्ट / ठेका कर्मियों को बगैर टेट हटाया जा रहा था और उसके बारे में केंद्र सरकार  की ट्रिब्यूनल कोर्ट ने निर्णय दिया है , अगर
प्रशिक्षित (टेट पास ) कर्मी नहीं मिलते है , तो अप्रशिक्षितों से काम चलाया जा सकता है ।
हिंदुस्तान  में बहुत सारे विभागों के अपनी कोर्ट स्वयं होती है , जिस से वह जल्द फैसले दे कर काम काज में आ रही बाधा को हटा सकें ,
ऐसे ही केंद्र सरकार ने केंद्रीय प्रसाशनिक प्राधिकरण  ( सेंट्रल एडमिनिस्ट्रेटिव ट्रिब्यूनल ) बना रखी है ।

संविधान के तहत न्याय पाने के लिए उस से ऊपर हाई कोर्ट , फिर सुप्रीम कोर्ट है
